The Short Version
Diffusitron is an AI art creation app built by Extropolis Corp. ("Extropolis," "we," "us," "our"). These Terms of Use ("Terms") govern your access to and use of the Diffusitron mobile app for iOS and Android, our website at diffusitron.art, and any related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service. Simple as that.
Eligibility
You must be at least 13 years old to use Diffusitron (16 in the EEA). By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you're using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Your Account
You need an account to use most features. You can sign up with email/password, Google Sign-In, or Apple Sign-In. You're responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access
Don't share your account, create multiple accounts to circumvent limits, or impersonate another person.
What You Can Do
Diffusitron lets you generate AI images and videos using various models and engines. You can also refine, upscale, animate, edit, and remove backgrounds from images. Some of these features run on-device, others use cloud-based AI services.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal and commercial purposes, subject to these Terms.
Content & Ownership
Your Content
"Your Content" means images, videos, prompts, and other materials you create using or upload to the Service. You retain whatever rights you have in Your Content. We don't claim ownership of what you create.
License You Grant Us
By using the Service, you grant Extropolis a worldwide, non-exclusive, royalty-free license to host, store, and process Your Content as necessary to operate the Service. When you publish content to the public feed, you additionally grant us a license to display that content to other authenticated users within the Service.
AI-Generated Content
Images and videos generated by AI models may be subject to the terms of the underlying model providers. We do not guarantee that AI-generated content is unique, original, or free of third-party IP claims. You are responsible for how you use AI-generated content, including ensuring it complies with applicable laws and does not infringe on others' rights.
Our Content
The Service itself — including the app design, branding, code, and documentation — is owned by Extropolis and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logos, or other brand features.
Public Feed
The public feed is opt-in. When you publish content, the following becomes visible to all authenticated users: your image or video, generation parameters (prompt, model, seed), your username, display name, and profile photo. Other users can like and flag your content.
You can unpublish your content from the public feed at any time. Published content may have been viewed, saved, or referenced by other users before you unpublish it.
Acceptable Use
You agree not to use the Service to:
- Generate, upload, or distribute child sexual abuse material (CSAM) or any sexual content involving minors — this will result in immediate account termination and reporting to authorities
- Generate content that depicts real, identifiable people without their consent, particularly in sexual, defamatory, or harmful contexts
- Create deepfakes or synthetic media intended to deceive, defraud, or harass
- Generate content that promotes violence, terrorism, or self-harm
- Violate any applicable law, regulation, or third-party rights
- Attempt to reverse engineer, decompile, or extract source code from the app
- Circumvent rate limits, token balances, subscription restrictions, or other usage controls
- Use automated tools, bots, or scripts to access the Service
- Interfere with or disrupt the Service or its infrastructure
- Harass, abuse, or threaten other users through the public feed or any other feature
We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.
Subscriptions & Payments
How Billing Works
Diffusitron offers free and paid tiers. Paid subscriptions and token purchases are processed entirely through the Apple App Store or Google Play. We never see or store your payment card details.
Subscription Terms
- Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription through your device's App Store or Google Play settings
- Price changes will be communicated in advance; continued use after a price change constitutes acceptance
Refunds
Refunds are handled by Apple or Google according to their respective refund policies. We cannot process refunds directly. If you believe you were charged in error, contact Apple or Google support, or reach out to us and we'll help where we can.
Tokens
Some features consume tokens (generation credits). Tokens included with your subscription refresh each billing cycle. Purchased token packs do not expire. We reserve the right to adjust token costs for specific features as model pricing changes, but we won't retroactively reduce your existing balance.
Third-Party Services
The Service relies on third-party providers for AI generation, infrastructure, payments, and analytics. These include Civitai (image/video generation), Firebase (backend infrastructure), RevenueCat (subscription management), Mixpanel (opt-in analytics), and Apple/Google (payment processing).
Your use of these third-party services is subject to their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services. If a third-party service experiences downtime or changes its terms, some features of Diffusitron may be temporarily unavailable or modified.
On-Device Processing
Some features — including background removal, image editing, and saving to your photo library — run entirely on your device. These features do not send data to our servers or third parties. On-device features depend on your device's hardware capabilities and may not be available on all devices.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We don't warrant that:
- The Service will be uninterrupted, error-free, or secure
- AI-generated content will be accurate, appropriate, or unique
- Generated content won't infringe third-party rights
- The Service will meet your specific requirements
AI models can produce unexpected, inaccurate, or offensive outputs. You are solely responsible for reviewing and using generated content appropriately.
Limitation of Liability
To the maximum extent permitted by law, Extropolis and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $100 USD.
Indemnification
You agree to indemnify and hold harmless Extropolis from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party rights.
Termination
You can delete your account at any time through the app's settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will delete your personal data and private gallery content within 30 days of account deletion, subject to our Privacy Policy.
Sections that by their nature should survive termination will survive, including Content & Ownership, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
If you don't agree with the updated Terms, you should stop using the Service and delete your account.
Governing Law & Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in California.
Before filing a formal dispute, you agree to first contact us at legal@extropolis.ai and attempt to resolve the matter informally within 30 days.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
